Majura Lucky Draw Terms and Conditions

Conditions of entry for Toymate Majura Lucky Draw Prize Draw 

Saturday 9 November & Sunday 10 November 2019 

Information on how to enter and the prizes form part of these conditions of entry. Entry into (or participating in) the competition is deemed acceptance of the terms and conditions. 

To be eligible to go into the Promotion draw, participants must be over the age of 18 (or with a parental guardian) and a resident of Australia Capital Territory.  

1. To enter the Lucky draw Prize competition, the eligible entrant must complete a Competition entry form at Toymate Majura and place it into one of four entry points – located at various points within the Toymate Majura store.  

1. Only one entry is permitted into each Lucky draw prize promotion. 

1. No responsibility is accepted for late, lost, or misdirected entries. All entries become the property of the Promoter. 

1. Incomplete, indecipherable or illegible entry forms will be deemed invalid. 

1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. 

1. One winner will be selected by a random draw which will take place on 9 and 10 November 2019. There are three (3) random draws over the on Saturday 9 November and three (3) on Sunday 10 November as outlined in Clause 8. 

1. Entries are valid for one draw only. After the draw, all entries will be compiled and added to the Toymate database and a new entry pool will begin. 

1. The prizes for each draw are different. The prize pool for each is outlined below: 

1. A participant can only win one prize from the prize pool. 

1. The prize winners must be present at Toymate Majura store at the time or place of the drawing of the entries. The prize draw will take place at the front of the store. If the prize winner is not present at the time of drawing, a Toymate representative will repeat the winners name and after 30 seconds a new prize winner will be drawn (Prize Winner 2). If the Prize Winner 2 is not present at the time of drawing, a Toymate representative will repeat the winners name and after 30 seconds a new prize winner will be drawn (Prize Winner 3). If no Prize Winner claim their prize, the prize will be sent back to the prize supplier and that round of competition will have no Prize Winners.   

1. The Promoter will use reasonable endeavours to notify the prize winners after drawing time, however after 2 x name calls and 30 seconds, a new Prize Winner will be announced. Please note: Due to high foot traffic on the day, the promoter will not be liable if the prize winner does not hear their name if they are not present at the front of the store.  

1. The Promoter does not accept responsibility for the inability to contact a prize winner within a reasonable time after the end of the Promotion. In the case that the winner cannot be located, another winner will be selected and notified as set out in these Terms and Conditions. 

1. The Promoter’s decision as to the winners of the prizes will be final and binding and no correspondence will be entered in relation to the conduct of the Promotion or otherwise. 

1. The Prizes are not transferable, refundable or exchangeable and cannot be taken as cash. 

1. If a prize is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification. 

1. The Promoter will not be held responsible for the loss, theft or damage to any prize after it has been awarded. 

1. The Promoter reserves the right at any time to verify the eligibility and identity of any participant and to disqualify any participant who does not comply strictly with these Terms and Conditions. 

1. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize. 

1. Each participant indemnifies and keeps indemnified the Promoter against all claims, losses, damages and expenses suffered by the Promoter or any third parties arising out of the breach of these Terms and Conditions by the participant, the conduct of the participant in the Promotion or the use of a prize. 

1. The Promoter may but is not obliged to publish the results of the Promotion. Unless otherwise advised by the participant. 

1. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by the law to (a) disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate. 

1. Under the Information Privacy Act 2009 (Qld), the Promoter must tell participants when they collect personal information about them and how they plan to use it. If a participant chooses to enter or take part in the Promotion, the participant will be required to provide the Promoter with personal information such as the participant’s name, phone number and email address. The Promoter collects participants’ personal information in order to conduct the Promotion. 

1. A request to access, update or correct any information should be directed to the Promoter. If the participant would prefer that the Promoter does not use the participant’s details in the way outlined in these Terms and Conditions the participant should contact the Promoter.
